Correctly Classifying Laborers and Mechanics
Understanding who counts as a “laborer or mechanic” is the foundation of PWA compliance. Only hours performed by these roles trigger prevailing wage and apprenticeship requirements under the IRA.
Key Criteria for Coverage
- Laborers and mechanics: Includes workers whose duties are physical or manual in nature—electricians, carpenters, civil laborers, solar installers, HVAC, pipefitters, and similar trades. This includes apprentices registered with a qualifying program (DOL: IRA Wage Guidance).
- Forepersons/Supervisors: Only included if they spend more than 20% of their time in hands-on work on site (IRS: Form 7220 Instructions).
- Exclusions: Professional engineers, architects, office and administrative staff, and most supervisors unless they meet the hands-on threshold.
Why this matters: Only “covered” labor hours affect your apprentice ratios, wage requirements, and Form 7220 reporting (IRS: PWA Requirements).
Hypothetical Example
Suppose your electrical contracting crew includes:
| Name | Role | % Hands-on Work | Covered? |
|--------------|----------------------|-----------------|----------|
